Une loi qui ne semble pas \u00eatre du tout, la bienvenue pour les promoteurs immobili\u00e8res burkinab\u00e8 qui depuis lors n\u2019ont cess\u00e9 de la d\u00e9noncer. Ce fut encore le cas, ce vendredi 24 septembre 2021 \u00e0 Ouagadougou o\u00f9 ils ont\u00a0 au cour d&#8217;un Caf\u00e9-d\u00e9bat mis en place par le R\u00e9seau des Journalistes et Communicateurs pour l&#8217;Habitat, l&#8217;Urbanisme\u00a0 et l&#8217;Assainissement (RJCHUA), expliqu\u00e9 les diff\u00e9rents points de discordes de cette loi avec l\u2019autorit\u00e9, aux hommes des m\u00e9dias, en pointant du doigt certains de ses d\u00e9crets.<\/strong><\/p>\n<p>Tout en pointant du doigt la mauvaise gestion du foncier d&#8217;un plan global, les promoteurs immobiliers par l&#8217;expos\u00e9e de <strong>Aristide SAWADOGO<\/strong> ont relev\u00e9 par le pass\u00e9 des d\u00e9faillances sur les lotissements ant\u00e9rieurs. Pour l&#8217;heure au cour de ce Caf\u00e9-D\u00e9bat\u00a0 plusieurs points fondamentaux ont \u00e9t\u00e9 abord\u00e9s.<\/p>\n<p>En ce qui concerne, les motifs insuffisants et injustifi\u00e9s de la r\u00e9forme, les promoteurs immobiliers notent entre autres la vente des terrains nus, la non viabilisation des sites, l&#8217;accaparement du foncier rural \u00e0 des fins de promotion immobili\u00e8re,\u00a0 les d\u00e9lib\u00e9rations irr\u00e9guli\u00e8res des conseils municipaux sur les superficies et la d\u00e9mesure des superficies. Les promoteurs immobiliers estiment que les motifs sont insuffisants pour justifier une r\u00e9vision de la loi et ce d&#8217;autant plus que les textes actuels contiennent d\u00e9j\u00e0 des \u00e9l\u00e9ments de r\u00e9ponse.<\/p>\n<p>Les promoteurs immobiliers stipulent qu&#8217;il y a des faces cach\u00e9es de la r\u00e9forme. Ils d\u00e9noncent une d\u00e9naturation de l&#8217;activit\u00e9 de promotion immobili\u00e8re qui r\u00e9sumerait au BTP, un projet de loi qui instaure un monopole d&#8217;Etat et une discrimination n\u00e9gative entre les soci\u00e9t\u00e9s de droit priv\u00e9 et les soci\u00e9t\u00e9s de droit public, un projet de loi qui apparait comme un moyen\u00a0 pour l&#8217;Etat de r\u00e9cup\u00e9rer la terre des particuliers et le projet de loi par son dispositif r\u00e9pressif qui n&#8217;est pas incitatif pour l&#8217;activit\u00e9 \u00e9conomique et qui se substitue au code p\u00e9nal.<\/p>\n<p>Au sortir des diff\u00e9rentes remarques sur la r\u00e9forme, les promoteurs immobiliers ont formul\u00e9 des proposition pour une r\u00e9forme juste et \u00e9quitable.
